Automaton at My Lai court ruling on orders defense

The military judge in a My Lai court martial ruled that postwar Nuremberg trials eliminate obedience to orders as a defense. Sgt Charles Hutto faced charges of assault with intent to kill six civilians in My Lai March 16 1968. The psychiatrist testified Hutto was mentally unable to disobey orders, but the judge said the issue was whether Hutto considered legality of orders. Prosecution witnesses said Capt Ernest Medina ordered the destruction of My Lai. Hutto, 22, from Tallulah La, argued he could only obey orders. The judge allowed limited testimony on mental state while rejecting the defense as to legality of orders. The psychiatrist linked Hutto to paternal authority shaping his military obedience.
