NAACP appeals over Dayton busing burden of proof
The NAACP seeks to revive a court ordered desegregation plan in Dayton Ohio arguing the burden of proof rests with the wrongdoer and that the district has not shown current segregation results. The Justice Department backs the NAACP, criticizing Judge Rubin for treating each act in isolation and misplacing the burden of proof. The 6th U.S. Circuit Court of Appeals will hear arguments on revoking or upholding the plan.
