Sulfur dioxide controls upheld by appeals court
In Cincinnati, the 6th U.S. Circuit Court of Appeals upheld Ohio sulfur dioxide pollution standards for industry. The ruling, unanimous, supports the EPA’s formula that bases limits on plant capacity using a stack-by-stack method and assumes 24-hour daily operation at full capacity. About 32 companies had challenged the method as too lenient or flawed.
