Guardsmen Entitled To Benefits
Franklin County Common Pleas Judge Myron B. Gessaman ruled Ohio National Guard members receive Workmen's Compensation Act benefits during annual active duty training. The decision favors 1st Lt. James L. Williams who sought pay for injuries from a August 13, 1960 traffic accident en route to Camp Grayling Michigan while on two weeks active duty. Williams served in the military police detachment of the 37th Infantry Division. The suit contends he was on temporary duty, not state employed, when injured. The 1959 act covers guardsmen and federal funds funded the training, but the court found active duty orders by the governor or designee valid.
