Permit Nips Court Test For Zoning
Controversial interim zoning adopted last year by Butler County Commission faces a setback as Armitage of Middletown obtained a permit to build a service station and ice cream shop on Jackson Lane after suing the zoning measure in Common Pleas Court. Harley Anglin of Hamilton was denied a permit for a utility building for a proposed trailer park on the Hamilton Middletown Pike but expected to receive one soon. Judges P. P. Boll considers the constitutionality of the zoning order as suits remain pending. Earlier suits, Floyd Ballard and a theater developer, were resolved by permits or sale of property before decisions.
