Death Row Cases Argued Before Supreme Court
In Washington AP lawyers for California and the United States argued that juries would impose more death penalties under fixed standards. Griswold opposed rigid standards, saying they would prompt harsher outcomes. McGautha and Crampton, two condemned men, challenge current discretion, urging abolition or two stage trials to protect fifth amendment rights.

Supreme Court rejects war legality suit by Massachusetts
The Supreme Court, in a 6-3 vote, refused to hear Massachusetts suit challenging U.S. Vietnam actions without a formal war declaration. Justice Douglas dissented, with Stewart later joining, as the court left in place the long pattern of declining such challenges. Massachusetts needed four justices to agree to hear the case.

Lawyer Wasn't In Contempt
Missouri Supreme Court ruled Kansas City lawyer James L. McMullin was not in criminal contempt for failing to appear in Mexico for a trial. He had been jailed after a $250 fine and costs, but the court dismissed the citation, noting no contempt of authority existed. The decision discussed conflicts between judiciary and lawyers as officers of the court. It also upheld an innocent verdict for Dr. Irvin I. Bernald in a separate case.
