Uncertain Life Insurance Case Heads to Circuit Court
In Charlotte next week the circuit court will hear a case involving William McAllister of Battle Creek who died in Findley, Ohio in 1900. The Maccabees policy for 4000 has paid 300 in sick and order benefits, leaving 1700 to be paid. The policy names Clara Baker McAllister as wife, but Eleanor McAllister of Battle Creek claims McAllister never married and that Frank Baker is her real husband. An interpleader suit, with Eleanor McAllister and Clara McAllister as co defendants, seeks to determine rightful ownership and payout. The case has drawn wide attention from life insurance firms and local readers.
