Three boys aged 12 to 13 faced first degree murder charges in the death of homeless man Charles Scales 38 after they soaked him with lighter fluid and set him afire in an alley behind an abandoned building Also charged with two counts of assault with intent to commit murder they allegedly set two other men on fire but were beaten back by the victims The incident began with the boys burning a cat then striking the sleeping men while they had no place to sleep Spratling 93 survived while Scales died in a hospital the boys were described as on a weekend pass or in custody and were returned to a youth facility or home The police said the act was spontaneous and involved four cans of lighter fluid stolen at a local market
