Supreme Court bars death by hanging jury in Witherspoon case

The Supreme Court ruled five to four that a jury exclusion policy based on religious or conscientious scruples against capital punishment is unconstitutional. Justice Stewart led the majority saying a death sentence cannot be imposed by such a tribunal. The decision affects the Witherspoon case from Illinois where 39 veniremen were excluded. Justice Black dissented. The court did not rule on the death penalty itself and kept provisions allowing challenges for cause to jurors with objections to capital punishment. See SUPREME Page 10.
