In St Louis on October 21 the United States Court of Appeals ruled that a suicide clause cannot be used by an insurer to deny payment unless it can be shown the insured at the time of taking out the policy contemplated death by his own action.
Washington October 21 Admiral Dewey has canceled proposed trips to Philadelphia and Atlanta by advice of his physician and will accept no more invitations.
Washington reports Otis cables that transports Sherman and Elder reached the Philippines. Sherman carries the Thirtieth volunteers while Elder arrives with five hundred enlisted men aboard.

Senator Proctor of Vermont denies involvement in a Dewey presidential boom and says he is out of politics. He told Washington reporters there is nothing to the rumor and that Dewey is likewise out of politics. The remark followed questions about his so called special charge on the Dewey bid.
Despatches from Mafeking report Col. Baden Powell sending two dynamite trucks nine miles out to lure shelling by Boers. After the engine uncoupled and retreated, the trucks were shelled and exploded, an estimated 100 Boers killed.
A Lowell man acted as stake holder for New York boxing bets on a Gardner Haner bout. He fled with the stakes after threatening arrest, was later arrested, posted 200 bail, and returned home a winner by 3500 despite not paying 700 in bets. New York promoters vow to target visitors from Boston area.
Middlesex county grand jury reports at the court house with Edward J. Gaffney ordered to trial for manslaughter in the burning death of his wife. Indictments also returned including Kelley for murder of Theresa Kelley, and numerous larceny and breaking and entering cases across Lowell Woburn Natick Framingham Acton and other towns. The court adjourned with the jury to report to Cambridge at 12 30 PM.
Chicago Oct. 20 At a directors meeting it was announced negotiations are concluded for Pullman to purchase all Wagner assets including contracts with railways. 200000 Pullman shares to be issued, stockholders to ratify. Special meeting set for December 5. A quarterly dividend of two dollars per share was declared payable November 16 to stockholders of record November 1.
New York October twenty a d a district attorney accuses Bartow Weeks counsel for Roland B Molineux of tampering with a key witness. Osborne says the state is ready to try Molineux immediately if Weeks informs the Newark based witness Robert Seller to come to the city for subpoena service.
New York reports no contest in the Vanderbilt will dispute. Senator Depew says the will may be offered next week, with Mr Anderson in sole charge of the document. Young Cornelius Vanderbilt had allegedly consulted counsel about opposing probate, but now shows no intention to challenge.
Judge Lacombe of the U S district court dismissed the writ of habeas corpus for former Capt Oberlin M Carter serving a five year sentence for conspiracy to defraud the government in contracts. The opinion upholds the court martial findings in New York dated October 320.
In police court yesterday Coolidge R Johnson, former alderman, sued Rachel Summer to replevy furniture. Johnson admitted giving some pieces but claimed the disputed items were left with Summer for safekeeping. Items include a sideboard divan and two chairs. Parties met in 1892 amid a furniture gift of 300 to 400 dollars. Judge Hadley reserved decision. attorneys Peter A Fay for defendant John J Pickman for plaintiff.

Edmund D. Fletcher died this morning at his home in Lowell age 76. He was born in Dedham October 1, 1823 and helped organize Nichols and Fletcher grocers in 1848. A Republican, he served on the common council and board of aldermen. He leaves one daughter Mary Bb Fletcher and a large circle of friends. Also mourning are Mrs Piiza A. Fiske of Centralville and Joseph F. Prescott of Forge Village with surviving relatives.
Officer John Hurley observed two men on Market Street carrying a peculiar parcel. They dropped it and fled, pursued by the officer. The recovered item was a lubricator from the Detroit Lubricating Company, likely stolen from a mill or machine shop engine room.
John J Scanlon, the lad who hired a bicycle from a Manchester store, was found in Lowell by inspectors. Inspector O Dowd notes the boy's light attitude. Charles Quigley of Wy street attempted to board a moving electric car at the corner of Middlesex and South streets about 6 50 last night and fell badly, cutting his rose and rendering him unconscious. An ambulance carried him to St. John's hospital.

F A Keyes of Pelham faced Hudson police court on Thursday for snaring partridges and shipping them out of state. He was fined 119 dollars and 8 cents and sentenced to 600 days in jail, suspended on good behavior, with the fine paid.

Nine drunks appeared in police court this morning with varied penalties. George Coleman Michael F Shay and Adelard Champagne first offenders were fined five dollars each. Mary Crowley and Peter Crowley second offences were fined six dollars. Catherine Smith a third offender received one year at Sherborn, appealed and was held for the superior court in two hundred dollars. James Magle pled guilty to drunkenness and threats, fined five dollars and held for six months to keep the peace in one hundred dollars. Edward and Ellen Whitman, old offenders, to serve at the State farm. Catherine Smith withdrew appeal accepting one year at Sherborn. Christos Astinoma was visited by the Squaw inspector at Moody street and caught selling a glass of whiskey. case delayed to next Saturday with request for continuance. W A Hogan represented him. Victor Vashon pleaded guilty to keeping liquor and was fined one hundred dollars. Walter Ashworth withdrew his appeal and accepted the ten months sentence for larceny. Dracut officers recovered stolen goods on Lawrence road near Dewey grove with eleven camps reported. A large express wagon full of items and three cottages yielded the loot.
Massachusetts news notes a theft at the Plainville post office with losses not yet quantified. Julius Hahler of Roxbury committed suicide at his home using a butcher knife after a period of illness. Workmen in Quincy uncover part of a human skeleton during water main construction. After two years, haddock fishery vessels will switch to an open market in Gloucester with plans for Boston firms to open in the city on November.
Thomas Smith of Summer street Lynn was knocked down and robbed of his watch and chain Friday afternoon. Michael Higgins, an ex prize fighter, is arrested and charged with the act. Smith identified Higgins as the assailant after Higgins fled through an alley. Higgins is held for examination.
