Texas Court Rules School Financing System Unlawful

U S District Court Judge Jack Roberts held the Texas school financing system unconstitutional under both federal and state constitutions. Education Commissioner J W Edgar and the Texas Board of Education were defendants. The ruling endorses fiscal neutrality, rejecting arguments that federal money alone equalizes differences and noting state choice was limited by wealth-based classifications. The suit, filed in 1968, followed a Dec 10 trial after years of delay and may be appealed directly to the United States Supreme Court.
