A Fourth District judge dismissed Idaho’s multimillion dollar suit against tobacco firms for costs of treating smoking related illnesses, saying the state failed to prove violations of consumer protection, antitrust, and public nuisance laws. The ruling echoed an Indiana decision.
Earl reduced to 80 mph top winds as it nears the Panhandle with floods and tornado watches. Residents board up, evacuations urged, shelters opened. emergency declared across the state amid warnings of continued heavy surf and coastal flooding.
A federal panel endorsed tamoxifen for women at high risk but stopped short of calling it a true preventative. The panel also backed Herceptin for certain advanced breast cancers, noting tumor biology limits its applicability to about a quarter to thirds of patients.

Madonna files affidavits to halt a YMCA planned high rise near Lincoln Center citing danger to her child and pointing to a July elevator shaft accident at a Times Square hotel. The suit, supported by an Aug. 16 coalition filing, targets the YMCA the Buildings Department and a realty firm. The city says DB officials will ensure site safety while Madonna’s daughter Lourdes turns two in October.
