Supreme Court strikes down 1934 municipal bankruptcy act
Washington May 25 The Supreme Court ruled the 1934 municipal bankruptcy act unconstitutional in a 5 to 4 decision. Justice McReynolds delivered the opinion sustaining the challenge that the statute violated state rights and due process. The dissent, including Cardozo Hughes Brandeis and Stone, contended the act was constitutional. Bondholders from Cameron County Texas Water Improvement District No. 1 argued they received only 49.8 percent of face value under the plan. The ruling affects cities counties and other subdivisions seeking debt relief through federal bankruptcy courts. The decision also notes the government failed to win approval to reduce stockyard service charges and Arizona was denied permission to sue California and other states over Colorado River water rights.
