Kansas evidence retention laws under scrutiny in Wichita Eagle report
Legal experts in Kansas say state rules on preserving evidence are weak and enforcement is lax. Judges must issue orders to destroy items, yet no penalties exist for noncompliance. The Wichita Eagle cites a 30 year old murder case where hair samples and a supposed murder weapon were destroyed without a court order. Ronnie Rhodes seeks relief, arguing the destruction hinders justice. Students at Washburn Law study the issue, noting inmates lack advocacy to maintain evidence.
