Supreme Court upholds lease dispute over Topeka rock quarry
In Topeka on June 12 the Kansas Supreme Court affirmed a Douglas county district court ruling regarding a lease between Henry and Lecompton resident Mrs Leslie and Paul Sherman of Topeka for 53 acres of rock quarrying. Sherman paid one cent per cubic yard. later provide rock to Kaser Construction at five cents per ton for the Topeka air base. The Leslies sued claiming the lease invalid and sought rock value. The Kaser company collected funds during litigation and deposited over $11,000 for court distribution as district judge Hugh Means ruled Sherman did not commit fraud. The Leslies appealed.
