Kansas Court Rules 2013 Workers Comp Law Unconstitutional
The Kansas Court of Appeals holds the 2013 sixth edition workers compensation act unconstitutional on its face. The ruling says the law violates the Kansas Bill of Rights and the U.S. Constitution by denying due process for injuries after January 1, 2015. The decision addresses the broader struggle between business groups seeking lower insurance costs and labor advocates seeking fair compensation. Judges McAnany Leben and Schroeder signed the opinion. the attorney general may consider an appeal to the Kansas Supreme Court.
