Appeals court overturns 2013 Kansas workers' comp law
Kansas Court of Appeals on a three judge panel ruled the 2013 change to the workers' compensation law unconstitutional because it overly limits an injured worker's access to a legal remedy. The case centered on Howard Johnson III who injured his back at U S Food Service in October 2015 and underwent spine fusion surgery with a 25 30 percent chance of future surgery. Johnson returned to work but soon had recurrent symptoms and filed a claim after the new law took effect nine months earlier, reducing potential settlements by adopting the AMA Guides Sixth Edition.
