The Indiana Supreme Court says Woodruff Place property owners must share the cost of improving Clifford Avenue. Raschig, owning property on Woodruff Place beside Clifford Avenue, challenged assessments of 3606.14, arguing the strip two feet from the street was not within Woodruff Place and that the lot did not abut Clifford Avenue. The court held Clifford Avenue is the common boundary and the two foot strip constitutes an easement in favor of Woodruff Place owners, so Barrett law allows backability for improvements and over half of Clifford Avenue lies within Woodruff Place.
The wife of William Malady, arrested Thursday for entering a home to commit a felony, was tried Friday for bigamy as Mrs Silvia M Malady. Testimony showed she believed Malady dead after a railroad accident, married Jacob Wayt, and faced divorce proceedings. Malady was found in Alice Shipman's room unconscious from chloroform used earlier in an attempted assault. Judge McCray discharged her, noting her belief in her husband’s death.
Attorney I. F. Ritter accepts invitation to judge a Chicago debate between the Universities of Michigan and Chicago on April 29. The topic asks whether the British cabinet government is more suitable to democracy than the U S presidential system.
Charges of immorality were brought Thursday against Rev. Tubbard C. Farrar, pastor of St. Luke's church in Albany, in the Troy conference. A former servant girl, said to have borne a child, is the chief witness after a physician reported the matter. The physician informed the church and secrecy was urged but the case was discussed openly by conference leaders. Farrar has long been a prominent member in the Troy conference and renown across the denomination.
Hezekiah Dailey a well known Indianapolis attorney and gallant Civil War veteran died suddenly at home aged 51. Born in Payette county he served with Company F Third Indiana Cavalry and fought at Gettysburg. He was praised for bravery and later a respected lawyer with a strong court presence. His death followed grief over his oldest daughter's passing and he had studied spiritualism seeking a message from her. The bar association prepared resolutions honoring his life and service.
Judge Showalter in Chicago grants injunction to restore five cent fares in Indianapolis streetcar case. Central Trust Co. and Citizens Street Railroad Company battle over the 1897 amendment declaring three cent fares in Indianapolis only. Ruling cites state constitutional limits on local special laws and federal contract clause. five cent fares to be collected immediately by conductors.
