Judge Refuses Bid to Mix Ala. Schools
A federal judge refused to order desegregation of Birmingham schools, citing that Alabama's pupil placement law must be applied without discrimination. Judge Seybourn A. Lynne denied injunctive relief, saying the plaintiffs had not exhausted remedies under the 1956 statute, and noted the school system is segregated despite assurances of compliance. The ruling hinges on whether the state law is unconstitutional in application, with further testing of the placement system to follow.
