Habitual Criminal Act Upheld by Arkansas Supreme Court
The Arkansas Supreme Court upheld the constitutionality of the Habitual Criminal Statute in a case involving a 26 year sentence for grand larceny. Frank Dolphus Jr. argued it punished him for prior offenses, but the court cited a federal decision allowing enhanced penalties for repeat crimes and found no cruel or unusual punishment. Dolphus had prior imprisonment in Oklahoma and Michigan for theft and attempted larceny. He was convicted in Crittenden County for the 1968 theft of $50 from a West Memphis grocery store.
