Kolbs Duty to Deliver Lumber Amid War Produc tion Rules
The Supreme Court upheld a Pulaski chancery ruling that WPB priority rules did not bar Vernon Duncan from delivering 60 feet of lumber to R A Cook under a June 29, 1942 contract. The decision found the deal excluded the timber from government prohibition despite later WPB limits on pine sales. It also affirmed a Mississippi county ruling that Potushnick Local Truck System owed G T Archer additional wages under the Fair Labor Standards Act, determining whether Archer as night watchman fell under FLSA or the Motor Carrier Act.
