Ring dispute ends as judge dismisses second suit
Circuit Judge Guy Amsler yesterday dismissed the second of two lawsuits involving Mrs. Moore of Hays Kansas to recover rings. The case against Sam Levine, a pawnbroker, hinged on whether rings from Edward Harnik at Edwards Art Gallery belonged to the Moores. Levine testified he received rings from Harnik but did not confirm their identity or whether he had sold them, and he claimed a $17,000 payment. The judge ruled the rings had not been proven the same as those involved in a prior case and that recovery was barred by the statute of limitations. The Moores previously sued Harnik in federal court in Hot Springs, alleging they bought rings on December 15, 1952 for $43.00 and left them for resale, but Harnik refused to return them. They were awarded a $44.10 judgment against Harnik on April 28, 1936. seven days later Harnik filed for voluntary bankruptcy, and the Moores filed a claim.
