Benton state senator seeks halt to real estate transfer tax
State Sen. Vitel Fletcher of Benton said he will ask Chancery Court in Pulaski County to block the Revenue Department from collecting a real estate transfer tax. Martin Borchert, former mayor, filed July suit challenging constitutionality of the tax approved by the legislature this year. The suit did not seek injunction as tax collection began Aug. 4. AG's office notes unconstitutional pledges of revenue to bond payments. Fletcher will also question legality of the bill after the House voted to recall the measure just before Gov. Rockefeller signed it into law.
