Wilkerson Denies Capone Mistreated
Washington reports Jude James H. Wilkerson told a Senate committee that he gave Capone a 15 year sentence for income tax law violations. He said he allowed the guilty plea to be withdrawn after Capone's lawyer argued the court was bound to limit the sentence. He noted disagreement over conditions of the plea and potential sentence reduction. The issue centers on whether the government’s recommendation would be followed. A committee hearing concluded with Wilkerson’s statement aligning with District Attorney Johnson’s testimony. Confirmation of Wilkerson’s qualifications moves forward with a vote expected soon.
