Drink Tax Provisions Are Tested in Court Challenge
RALEIGH AP The constitutionality of a 1969 General Assembly soft drink tax is being tested in Wake Superior Court. John D. McConnell Jr represents Biggers Brothers of Charlotte, arguing the tax collection methods are arbitrary and discriminatory and impose higher costs on syrup and base-product distributors than on bottlers or powders. The suit contends the stamp method is costly and unfair, violating state and U.S. constitutions. The case is set for a full hearing after a temporary court order.
