North Carolina Court Finds Tax Unconstitutional
State authorities say further legal action is needed to determine the effect of the North Carolina Supreme Court ruling that a nine tenths of one percent unemployment tax on 1936 payrolls was unconstitutional. Some expect little of the $3,000,000 collected from employers to be returned, with retroactivity noted. Associate Justice Barnhill said the tax was retroactive to 1956 but applied to 1936 payrolls, while levies after 1936 remain potentially constitutional. E M Price of the state commission commented after the ruling.

Bank case on 1936 levy refunds and Social Security tax ruling
The court held the Wachovia Bank not liable for the 1936 refund sum but required payment of the 1937 payroll tax. Judge Barnhill explained that refunds would shift nine tenths of one per cent to the federal Social Security Board, with one tenth to the federal government, affecting states that did not participate. The ruling rejects bank exemption based on federal instrumental status and confirms state unemployment tax collection in 1937.
