Indictment Wording Caused Dismissal
In Fayetteville North Carolina Superior Court Judge D Marsh McLelland said differently worded indictments would have kept the misconduct charge against Cumberland County Sheriff Otis Jones. He noted two other indictments would have proceeded if phrased for a jury trial. The case concerns a warrant for a stolen gun and alleged political pressure on a Democratic worker. Grand jury foreman Alex G McBryde doubts another indictment will be sought.
