Washington April 27 Attorney General Dennis G Brummitt of North Carolina fled in the supreme court today brief opposing review requested by Col Luke Lea former senator from Tennessee and his son Luke Lea Jr of the action of the Tennessee supreme court ordering them extradited to North Carolina to serve sentences Convicted on charges growing out of the failure of the Central Bank and Trust Company of Asheville NC a 17000000 institution the Leas fought extradition They contended their conviction was illegal asserting the North via courts were without jn ion to try them because they were not in that state at the time the offenses charged against them were alleged to have been committed When the Tennessee supreme court refused to pass on the validity of their conviction and ordered them extradited to North Carolina they asked the United States supreme court for a re in North Carolina against the Leas were proper in every respect and that every material question the Leas now are attempting to raise is merely a rehash of re sprected in the former cases on the high court refused to pass
