Frank M Cole federal prohibition director for Texas has conferred with Governor Neff on the situation. The US district attorneys must have the evidence to prosecute. if the state law is inflexible in prohibiting surrender prosecutions may move to state or federal courts depending who made the arrest. Previously the Dean state law did not make possession of liquor an offense, so federal officers adopted cases and prosecutions in federal courts. This practice may end if the new state law prevents surrender of seized liquor to federal authorities.
