Man Pleads Not Guilty to Assault in Quarry Shooting

James B Backe a 12 year old boy was found dead on Southern Pacific tracks half a mile north of Russell City after celebrating Christmas with his brother Joseph 35. The brothers had been celebrating from 3 29 p m and at 7 30 p m they headed home James allegedly stumbled and was struck by a passing train as he walked along the tracks. Joseph found the body later and the train driver did not know anyone had been struck deputies said.
