More than a thousand miners returned to work at U S Coal and Coke mines in Gary West Virginia defying UMWA appeals. Eyewitnesses reported no picket lines as three mines ran full shifts and one partially staffed due to late notices. UMWA leader Jesse Aquino warned unions would help if Gary locals cannot prevent reopening. The Independent Employees association also voted to resume operations without a contract.

In Harlan Kentucky on May 17 400 additional national guardsmen were ordered to move where needed as coal mine negotiations stalled. Brigadier General Carter overseeing state troops said the 400 were available for rapid movement though not yet on duty. About 800 militiamen were present as Adjutant General McLain consulted with Carter and UMW leader Tumblazer who protested to President Roosevelt who voiced no plan to intervene.
