Defense attorney W P Samples cited unavailable witnesses, with a key Gaines witness in Michigan and a Curry witness not located. Civil jury trials begin Monday January 24, with petit jurors summoned. Gaines, 52, Flemington, father of 10, was indicted for murder of James Richard Brunson at a strip operation near Flemington on June 4. Brunson had been indicted on a bigamy charge earlier. Curry, of the Fairmont Grafton road, was indicted for attempted murder of Guy B Weaver and felonious assault of Charles T Weaver. Gaines posted bond, later reduced from 6,000 to 4,000. Curry is also out on bond.
