Kansas Water Act challenged again over groundwater use
Garden City farmer F Arthur Stone leads a fourth challenge to the 1945 Kansas Water Appropriations Act. The case, heard June 11 by the Kansas Supreme Court, questions whether state regulation of groundwater violates due process and private property rights amid fears of rapid Ogallala depletion. Stone argues landowners own underground water. opponents warn overturning the act would destabilize water rights and trigger chaos in Kansas water law.
