Ruling bars mountaintop coal mining waste dumping
Federal judge Charles Haden II ruled that the Army Corps of Engineers lacked authority to issue permits allowing mountaintop removal waste to be dumped into streams. The decision aligns with environmentalists who warn it protects Appalachia’s waterways and contradicts Bush era clean water rule changes. The ruling cites the Clean Water Act and follows a 1999 finding that such dumping violates federal law.
