JAG Tax Tips for Servicemen's State Residency
Lt. Paul M. Little explains that under the Soldiers and Sailors Civil Relief Act a serviceman’s state of legal residence determines tax obligations on military pay. The Army now sends Copy E of W 2 to the serviceman’s declared residence, or to the state of his duty station if none is declared, and a change requires physical presence, intent to stay, and abandonment of the old residence. Read DA Pamphlet 255-8 for guidance. DA and Patten offer further help.
