Missouri rate case ruling leaves freight and passenger laws under court jurisdiction
Judge Smith McPherson of Red Oak Iowa in Kansas City issued an opinion in the Wabash Railway company v Hadley et al case. The ruling retains federal jurisdiction to adjudicate Missouri freight and passenger law validity including the 1907 amendatory freight law. A decision on the Missouri railroads request for a temporary injunction against enforcement will come in a week or more. The court questions immediate enforcement of the two cent passenger fare until practical results show profitability.
