Exceeding Orders Vitiates Sale in Landermann v Gummeraell

The St Louis Court of Appeals held that when a seller overdelivers goods, the buyer is not obliged to accept or return at his expense. If the buyer tries to return and errs by sending to a wrong address, he bears liability for misfeasance, but damages are limited to the seller’s actual loss. The jury should not be instructed that the buyer must bear return costs or that failure to return entitles the seller to the goods’ value.

Monure and High Culture Farm Experiments on Superphosphate

Prof Roberts of Cornell notes superphosphate has little value in Rothamsted style trials. Across 20 years, 3 cwt per acre yearly yields a net loss after fertilizer costs, while 14 tons of manure per acre yields higher crop products but still shows substantial losses when priced against unmanured baselines. Ammonia salts with superphosphate also fail to yield net gains.
