The Albany Law Journal reports The People vs McGane from the New York Supreme Court Second Department. Section 6 of chapter 202 of the Laws of 1884 bans manufacture or sale of any oleomargarine designed to substitute for butter or cheese if made from non milk or non cream substances. The defendant, who sold oleomargarine derived from beef tallow, was convicted for violation. The court held the statute absolute, not limited to deceptive practices, and affirmed constitutionality under police power, noting the legislature may act with strong justification.

The Kentucky Superior Court in Sacha et al. v. The court also held that keeping the debtor employed as a salesman in a stock assignment does not constitute a fraud badge.
The Supreme Court holds that a husband’s nor a promissory note by the husband cannot bind a wife’s separate estate for supplies at a common dwelling unless there is clear proof she contracted the debt in her own name or intended to bind her separate estate.
