Overtime Rate Rising To Time And Half For All Workers

South Dakota and nationwide wage earners face a new law making overtime pay time and a half after 40 hours. The Wage and Hour Division reports about 9,744 workers in South Dakota may be affected in any busy week, with nationwide figures near 12.6 million covered and roughly 2 million directly affected by the change. Exemptions include railroad, truck and bus workers and retail or service employees. The shift, tied to the 1938 Fair Labor Standards Act, seeks a 40-hour standard and a 40-cent minimum wage, with earlier weeks showing the 40-hour standard gaining broad adoption in manufacturing.
