Judges Unable To Act As Attorneys In SD Courts
The attorney general’s office reports that county judges in South Dakota may not act as attorneys in cases started in their county courts. Pennington county judge previously acted for an administrator in an estate, with proceedings before the circuit judge. The 1929 legislature made such conduct a misdemeanor, and the opinion notes continued acts after passage violate the law, even after transfer or certification to the circuit court.
