Fair Trade Law Faces High Court Test
SIOUX FALLS, Feb 1 The fair trade law of South Dakota is headed for its first test before the state supreme court. Claude Hamilton attorney for Owl Drug Company of Sioux Falls said he will appeal Circuit Judge L L Fleeger’s ruling upholding the price fixing provisions. Hamilton plans to base the appeal on the state constitution’s protection against price fixing. A fair trade law identical to South Dakota’s has withstood challenges in seven state courts and the U S Supreme Court, he noted, though none contain the constitution clause cited.
