Habitual Criminal Has Life Sentence Cut To Ten Years

PIERRE Dec. 12 The Wife term given Theodore De Marsehe Burke as a habitual criminal was cut to 10 years on a third degree burglary counting a state supreme court opinion this week. De Marshe who was first sentenc ed to 10 years for burglarizing a Herrick liquor store appealed when that sentence was withdrawn and he was accused in another information and given life because of four prior convictions. A different judge passed judgment in the second instance and the court held it constituted imposing a sentence for the identical crime for which the defendant had already been sentenced. To avoid any misunderstanding the opinion said we wish to state that this opinion is of course limited by the diet situation before us. The effect of the law should it be shown that the judge first passing sentence was without knowledge of the prior conviction is not now before us neither is it necessary to decide whether the law as it now stands templates that prior convictions if known must be alleged in the information.
