CUOAT DECISION ON PRIVATE FISHERIES RIGHTS

The court analyzes historic royal grants and statutes to determine whether fishing grounds outside reefs were legally private property of landlords or held in common. It cites 1844 precedence, 1850 civil code, and 1899 reorganizations, concluding the plaintiff’s claimed rights and prior recognition as private property are supported, while noting the need for explicit grant of any fishing rights as an incident of land ownership. The decision discusses distinctions between general and specific laws and references Hawaiians cases such as Lellove and Hawaii statutes prior to 1900.
