Injunction Refused Over Sandusky Bay Bridge Dispute

A U S Circuit Court decision refused to enjoin the Junction and Port Clinton Railroads from building a bridge across Sandusky Bay toward Port Clinton. The complainant, a New York citizen with extensive Sandusky County holdings, argued the bridge would ruin his river commerce and mills. The court noted the need to show irremediable private injury for a suit, recognized the railroads’ charters, and examined whether the Port Clinton route to Port Clinton via Sandusky Bay falls within the original and amended acts. The ruling focused on whether the proposed crossing would obstruct navigation and commerce and whether the extension remains within the charter’s intent.

Port Clinton Bridge and Sandusky Bay Crossing Authority

A court reviews the Junction Railroad Charter and Port Clinton Railroad plan to cross Sandusky Bay. It affirms that crossing authority rests with the public works body or the Acting Commissioner, not the Board, and upholds Port Clinton approval for a bridge plan while acknowledging navigational obstruction concerns and public rights across navigable waters.
