Excise tax defeat viewed as bootleg boon in courts
New Orleans March 18 AP reports that the Fifth Circuit Court of Appeals ruled the 1926 Federal excise tax of 1000 on liquor dealers was a penalty tied to Prohibition and not a true tax, potentially boosting bootlegging in dry and wet states. The decision overturned a Birmingham retailer’s tax conviction, noting the levy fell with repealed Prohibition. Internal revenue says the tax is enforced in wet states as well.
