Murder suspect seeks to avoid death penalty in Florida case
Defense attorneys for 20 year old John Williams of Santa Rosa Beach seek to bar death penalty citing Florida law. They ask to dismiss grand jury indictment, declare death not allowed, sequester jurors individually, and strike aggravating circumstances as unconstitutional. Williams and co defendant Mickey Park face first degree murder and armed robbery charges over the August 21 beating and stabbing of Destin resident Ted Schery. Schery’s nude body was found August 22 in a Walton County drainage ditch along Highway 98. The men pleaded not guilty November 1. Terrell notes death penalty requires life or death sentence and may be by electric chair, which he calls cruel and unusual punishment. He filed motions to vacate the death penalty and seeks an evidentiary hearing. A hearing date has not been set. He also asked the court to bar juror questioning about death penalty opinions to avoid death qualification. Terrell argues death-qualified juries rush verdicts and bias capital juries. Williams was ordered psychologically evaluated recently and separately tried from Park, with trials set for December 27 in Shalimar Annex.
