Justice Department Defends Agnew Probe
The government argued that Vice President Spiro Agnew cannot claim constitutional immunity from indictment and trial. It urged that if indicted a trial could be delayed to allow impeachment deliberations, while opposing a halt to the grand jury investigation in Baltimore. The brief rejected Agnew’s claim of equal presidential immunity and noted no immunity for the VP where not stated. Agnew’s lawyers pressed for possible gallery trial and conviction removal only by impeachment, while subpoenaing newsmen to trace leaks. The department cited Vice President Aaron Burr’s 1805 case to show indictments do not force removal.
