Justice Goldsborough weighs pension injunction bid

Judge Goldsborough heard Ezra Van Horn seek an injunction to stop pension payments under the strike settlement of John L. Lewis and Senator Bridges. Bridges as neutral trustee and Lewis as UMW adviser pushed $100 monthly pensions for 62 year old miners with 20 years service retired after May 29 1946. Van Horn objected claiming invalidity under Taft Hartley and lack of employer approval. Lewis lawyers argued Van Horn must represent miner beneficiaries, not operators, on the board. The case hinges on whether Van Horn’s petition is in his capacity as trustee or as individual.
