Gift of Stock in Family Business At Issue in Suit Against U.S.

Piedmont Trust Bank sues the U.S. government claiming a $12,586.22 refund plus interest for estate taxes overpaid on Annie Beck Smith of Martinsville. The case centers on a plan to transfer Smith's Smith Wholesale stock to her children over five years to use a $30,000 gift exemption. She died before completing the transfers, and the government contends taxes were owed as a transfer in contemplation of death. The executor argues the estate should not be taxed since she did not expect to die at 48. The suit outlines the family business growth and the widow's plans to preserve it for the children amid questions of timing and tax implications.
