Legal challenge to warrant and oath in antisaloon case
Attorney argued the Rev C N McMillan affidavit violated code provisions and failed to compel oath examination of Antisaloon official. He contended the warrant lacked probable cause for the warehouse search and that the warrant was improperly returned to the police court, not Justice Browning's court, a fatal variance undermining the case.
